1. Two programmes
We run two separate schemes. Partner is a paid commission programme for approved agencies, consultants and creators. Referral is open to every paying customer and rewards in product credits rather than money.
These terms cover both, and they form part of our Terms of Service. Where a clause applies to only one programme, it says so. Everything here applies wherever you are; section 14 says what your own country adds.
2. Joining, and who may join
Partner is by application and approval. We may decline an application without giving a reason, and we may pause new applications or run the programme by invitation only. Approval does not create employment, agency, partnership or a joint venture between us — you are an independent business and you say so to anyone who asks.
Referral is automatic for customers on a paid plan. No application is needed.
To take part in either programme you must:
- be old enough to enter a contract where you live;
- hold a KaiBuild account in good standing, with no unpaid invoice and no open abuse matter;
- not be someone we are barred from paying under sanctions or other law that applies to us or to you.
3. What we pay
Partner commission is a fixed amount per plan, not a percentage, payable for up to twelve months from a referred customer’s first successful payment:
- Grow — $5 per paid month, or $50 once on an annual plan
- Scale — $10 per paid month, or $100 once on an annual plan
- Agency — $25 per paid month, or $250 once on an annual plan
A fixed fee is deliberate. It means a discount we run, or a price we change, does not silently re-price an agreement you already have.
Commission is calculated on the amount we actually collect, after any discount or promotional code, and will never exceed 25% of that amount. An annual plan pays once, not twelve times. Amounts are in US dollars.
Referral rewards are 1,000 credits to the referring customer and 500 credits to the person referred, granted once, when the referred account makes its first successful payment. Credits have no cash value, cannot be transferred or redeemed for money, and are governed by the Terms of Service.
Nothing here is an income promise. What you earn depends entirely on who signs up and keeps paying. We make no representation about typical or expected earnings and you should not make one to anybody else.
4. Attribution — how a referral gets credited to you
A referral is recorded when someone arrives through your link, and it is held in a cookie for 45 days. If a visitor uses more than one partner link inside that window, the most recent one before signup is the one credited.
Once a customer is attributed, they stay attributed. A later click on somebody else’s link does not move an existing customer from one partner to another. This is the rule that settles the "two partners, one customer" argument before it starts.
Attribution depends on the visitor’s browser accepting the cookie and on them signing in within the window. We cannot credit a referral we did not record, and we do not pay retrospectively on a customer’s say-so. If you believe attribution failed, tell us what happened and roughly when — we will look at the records, and if the fault was ours we will fix it.
5. When we pay
Commission becomes payable 30 days after the payment it relates to, so refunds and chargebacks can settle first. We pay monthly once your balance reaches $50. Balances below that roll forward; they do not expire, and we will pay a remaining balance on request if you leave the programme.
Your dashboard shows each entry and its state: earned and inside the hold, cleared and awaiting payment, paid, or reversed. That record is the evidence behind every payout, and it is why we keep reversals visible instead of deleting the row.
Payment is made by the method we agree with you. You are responsible for the accuracy of your payment details, and for any fee your own bank or payment provider charges to receive money.
6. Tax
Commission is gross income to you. You are responsible for your own taxes — income tax, and any sales tax, VAT or GST that applies to what you do — and for any registration your own country requires.
Where the law that applies to us requires tax documentation before we pay, or requires us to withhold an amount and remit it, we will tell you what is needed and pay you the balance. We do not give tax advice.
7. Refunds, failed payments and chargebacks
Commission follows money we keep. Specifically:
- A billing cycle that fails or goes unpaid earns no commission.
- A refund inside the 30-day hold cancels the related commission before it is paid.
- A refund or chargeback after payment is offset against your future earnings. We will not ask you to return money already paid.
- Repeated chargebacks on referred accounts may lead to review or removal from the programme.
8. Plan changes
If a referred customer upgrades or downgrades, commission follows their new plan from the next billing cycle. If they cancel and later return, the twelve-month period does not restart — it runs from their first successful payment, counted from what has already been earned on that customer.
If we change our prices, commission on existing referred subscriptions continues on the terms under which they were sold.
9. Telling people it is a referral link
Wherever you promote us, say plainly that you earn something if people sign up. Not in a footer, not in a hashtag nobody reads — near the link, in language an ordinary reader understands.
This is the rule everywhere, whatever your country calls it. In the United States the Federal Trade Commission requires a clear and conspicuous disclosure of a material connection; in the EEA and the UK, advertising and consumer-protection rules require the commercial intent of a communication to be obvious; India’s advertising rules expect the same of paid and incentivised endorsements. Rather than sending you to look them up, we ask for the thing all of them want: be obvious about it.
You are also responsible for following the rules of any platform you post on, and for the accuracy of what you say about the product.
10. Using our name and brand
While you are in the programme we grant you a limited, non-exclusive, revocable licence to use the KaiBuild name and logo to promote the Service. You may not alter the logo, use it as part of your own product name, register it or anything confusingly similar, or present yourself as us. The licence ends when your participation does.
Screenshots of the product are fine. Do not show another customer’s data in them.
11. What is not allowed
- Self-referral. You may not earn commission or credits on your own account, an account you control, or an account billed to you. Partners may of course be customers; their own subscription simply earns nothing. The system enforces this, and we also look at patterns it cannot see.
- Bidding on our brand name or misspellings of it in paid search, or running ads that appear to originate from us.
- Unsolicited email, SMS or messaging, or posting links where the venue’s rules forbid it.
- Claiming to be KaiBuild, or using our name, logo or branding in a way that suggests you are us or that we endorse your other work.
- Promising discounts, features, results or refunds we have not offered.
- Coupon-site listings, browser extensions, cookie stuffing, or any method that sets a referral without the visitor deliberately choosing your link.
- Automated, incentivised or fraudulent signups, including accounts created only to trigger a reward.
- Collecting people’s personal data to promote us without a lawful basis for doing so, or passing us data you were not allowed to share.
We may withhold or reverse any reward we reasonably believe resulted from a breach of this section. Where we do, we will tell you which referrals are affected and why, and you can put your side of it.
12. Data, privacy and confidentiality
Your partner dashboard shows what you earned and on which plan. It does not identify the customers behind those payments, because their account data is theirs and not yours. Do not ask us to confirm whether a named person is a customer.
Anything we tell you that is not public — unreleased features, negotiated rates, programme-wide figures — is confidential. Keep it that way while you are in the programme and afterwards.
How we handle your own personal data as a partner is covered by the Privacy Policy.
13. Ending participation
You may leave at any time. We may end your participation at any time, with notice, and immediately in cases of fraud or a breach of section 11.
If we close the programme entirely, we will honour commission already earned and any commitments running on referred subscriptions for the remainder of their twelve-month period. If we remove you for fraud, unpaid balances may be forfeited.
When participation ends, stop using our name and logo and remove or disable your links. Referral credits already granted stay in the account that received them.
14. Where you are
These terms apply to partners and referrers everywhere. Three things differ by place, and none of them can be waived by this page.
- Disclosure. Section 9 asks for the same clear statement everywhere; your local rules may be more specific, and they apply on top.
- Tax. Section 6 leaves this with you, because only you know where you are resident and what you must register for.
- Contractor status. In some countries a long-running commission arrangement has employment or agency implications. This programme is not employment, and if your local law would treat it differently, tell us and we will look at it rather than pretend the question does not exist.
15. Liability
Our total liability to you under these terms is limited to the commission properly earned and unpaid at the time of the claim. We are not liable for indirect or consequential loss, or for income you expected and did not receive.
You will cover our reasonable costs if a claim is made against us because of how you promoted us — what you said, where you posted it, or data you used to do it.
Nothing here limits liability that cannot lawfully be limited.
16. Changes to these terms
We may change these terms, including the amounts in section 3. Changes take effect for referrals made after the change; a referral already recorded keeps the terms in force when it was made. Material changes will be notified to active partners.
17. Contact and governing law
Questions about the programme, a payment, or an attribution you believe is wrong: [email protected]. Tell us the link used, the approximate date, and the account concerned. We acknowledge within 24 hours and aim to resolve within 15 days.
These terms are governed by the laws of India, with the courts of Surat, Gujarat, India having jurisdiction — the same as our Terms of Service, of which this programme forms part. If you take part as a consumer rather than as a business, the protections your own law gives you stand alongside this page and cannot be signed away by it.
